Part I - Introduction

1.1. Use and interpretation

1.1.1. The Kizzy Betting Rules (“Betting Rules” or “Rules”) form part of the Terms and Conditions.

1.1.2. The Rules set out here are subject to modification at any time at our sole discretion.

1.1.3. These Rules govern the use of the service. By placing a bet, the end user agrees they have read, understood, and will adhere to these Betting Rules. The Betting Rules include: this Introduction (Part I); the General Rules (Part II); and the Specific Rules for Social Media Betting (Part III).

1.1.4. The use of the service is at all times subject to the regulations imposed by the law applicable to the operations of the operator and authority supervising the operations of the operator and or the sportsbook.

1.1.5. The sportsbook reserves the right to make changes to the site, betting limits, payout limits and offerings without prior notice.

1.1.6. These Rules may be updated, amended, edited and supplemented at any time without prior notice.

1.1.7. Any reference in these Rules to words/objects that appear in singular also applies to plural. References to gender are non-binding and to be treated for information purposes only.

1.1.8. The purpose of these Rules is processing and redemption, if any, of the bets fairly, honestly and in accordance with these Terms.

1.2. Final Authority

1.2.1. Kizzy records shall be the final authority in determining the validity and Terms of any bets accepted and the circumstances in which they were made.

1.3 Definitions

1.3.1. Sportsbook - the online interface and all connected systems used by Kizzy to offer the betting services (including source code, software, tools and related infrastructure).

1.3.2. End user - an individual who has agreed to the betting Rules and places bets via the sportsbook.

1.3.3. Bet - a risk-based agreement between the end user and Kizzy on the outcome of an event or market.

1.3.4. Stake - the amount risked by the end user on a bet.

1.3.5. Outcome - the final result of an event or market used to settle a bet.

1.3.6. Market - a discrete betting proposition offered by Kizzy in relation to an event or metric.

1.3.7. Event - any social media, sports, esports, virtual sports, political, entertainment or other occurrence on which Kizzy offers odds.

1.3.8. Odds - the numerical coefficient assigned by Kizzy that determines potential winnings.

1.3.9. Winnings - the amount payable to an end user if their bet settles as a winner in accordance with the odds.

1.3.10. Operator - 100x Limited (Kizzy), the licensed entity providing the betting services.

1.3.11. Scoring Unit(s) - means the quantitative metric used to resolve a social media market (for example, views or followers).

1.3.12. Content Piece - a discrete social media post (such as a video or tweet), which for example in social media betting, can be tied to a view-based market.

1.3.13. Creator Account - a social media profile, which for example in social media betting, can be tied to a follower-based market.

1.3.14. Void - a bet settled at odds of 1.0 with the stake returned (unless otherwise specified).

1.3.15. Event Organizer - the internet-based platform or app on which the Content Creator Event was originally posted. For example: YouTube or X.

1.3. Betting Deadlines

1.3.1. Pre-event bets can be accepted up to the time indicated, which may not correspond to the start time of the event. Kizzy reserves the right to void any bet placed after the deadline indicated, including owing to content timing errors or revised start times. If a bet, for whatever reasons, is accepted after the start of a betting event meaning the bet is not placed in good faith then Kizzy reserves the right to void.

1.4. Data Errors

1.4.1. Kizzy reserves the right to refuse to accept any bet without notification, justification or compensation. Kizzy shall in no way be held liable for typing, transmission, display, publishing, betting information or odds errors. If any pre-event bet is accepted in error, Kizzy reserves the right to void that bet where there were obvious errors concerning the entry of odds and/or results, e.g. a mistaken inversion of teams, odds, results, etc.

1.5. Third Party Content

1.5.1. The App includes third-party content, such as social media activity and analytics. Kizzy is not responsible for, does not endorse and makes no representation either expressly or impliedly concerning this content and end users rely on it at their own risk.

1.6. Technical Errors

1.6.1. Kizzy reserves the right to suspend odds during an event due to failed transmission, other technical related issues, or for any reason. Bets may be canceled if any such bet was won by the customer as a result of a technical fault or error, inclusive of but not limited to an error or fault in transmission. In any such case bets will be voided. Customers knowingly exploiting technical errors or administrative errors may be held for any damages.

1.7. Customer Responsibility

1.7.1. Customers must understand all Rules related to their bets. By nature, social media betting is unpredictable. While the performance analytics of any event offered are subject to the integrity controls of their respective content platforms, there remains the possibility of user-driven manipulation and/or creator-driven manipulation, and the performance analytics that determine markets can cause debate with regard to accuracy. Customers are responsible for managing their own positions at all times.

Part II - General Rules

2.1. Placing a Bet

2.1.1. All stakes placed by an end user and all bets accepted by Kizzy are subject to these Betting Rules, as well as to applicable law.

2.1.2. For any bet to be valid, it needs to be expressly confirmed as accepted with a respective statement in the betslip.

2.1.3. It shall at all times remain the exclusive discretion of Kizzy, whether or not to accept any bet.

2.1.4. Bet type: Single (ordinary) - a bet on a separate outcome of an event. Single bet payout shall be equal to the amount of the stake times odds.

2.1.5. Market type: "Over/Under" (PvP or Pari-Mutuel Totals) allows customers to bet on the (partial or definite) amount of scoring units. Should the total amount of the listed units in the bet be exactly equal to the number of respective units listed in the betting line, then all bets on the “Under” on this offer will be declared winners. Example: an offer where the betting line is 100,000,000 views and the market ends with the result of precisely 100,000,000 views, all of the bets on the “Under” will be declared winner.

2.2. Events, Markets and Resulting

2.2.1. The dates and times of the events posted in the App are purely of informational character. Kizzy does not guarantee the accuracy of such information. An incorrectly posted time and/or date of an event is not the reason for voiding or refunding bets unless expressly provided otherwise in these Betting Rules.

2.2.2. The App may display live scores (Scoring Units) for informational purposes; however the accuracy of such information is not guaranteed and may not be used for the purposes of settlement of bets.

2.2.3. The bets on an event market shall be settled after the respective market has completed and the result has been determined.

2.2.4. The result of an event market will be determined at the time of the market's conclusion, unless the official result is provided later by the event organizer App or Platform. In the case if any event is provided outside of Kizzy competitions, then bets shall be settled using the information provided by the official event organizer.

2.2.5. If an event market has started and has not completed within 48 (forty-eight) hours of its scheduled ending time, then all bets on that event market may be void.

2.2.6. If an event market did not start within 12 (twelve) hours from its scheduled starting time on Kizzy, all bets on that event market may be voided, at Kizzy’s discretion.

2.2.7. The resulting and/or settlement of an event market suspended after the start of the event market will be made according to the sole discretion of Kizzy.

2.2.8. For the purposes of bet settlement no protested or overturned decisions changing the end results of any event/market shall be recognized.

2.2.9. Bets are placed on the outcome of an event/market, regardless of the scoring units at the time the bet was placed, for example, any incorrect scores displayed are not grounds for bets to be voided. For example, in a market where bets are placed on the change in followers across a fixed duration, the App does not guarantee the accuracy of the amount of followers at the time of event start and thus this market may not be voided if this amount of followers is an obvious error.

2.2.10. Bets on a specific period count only the scoring in that period, and are unaffected by what happens in any prior or a subsequent period(s).

2.2.11. Misspellings, typographical errors, creators changing names, and incorrect social media details (e.g., shorts, tweets, content, captions, replies, timestamps or metrics) shall not be a reason for a Bet to be void.

2.3. Acceptance, Suspension and Voiding of Bets

2.3.1. All bets will be accepted or rejected purely at Kizzy's discretion and subject to Kizzy's risk management policies (as applicable from time to time).

2.3.2. Kizzy reserves the right to refuse, restrict, cancel or limit any bet.

2.3.3. Kizzy reserves the right to declare the bets (or a part of them) void (payments are made with the odds «1») or to suspend payments until the end of trial (including judicial) in one of the following cases:

2.3.3.1. There are mistakes made when accepting the bets;

2.3.3.2. There is a software/website error (obvious typing mistakes in the list of offered events, discrepancy of odds in various positions, unusual or wrong odds, etc.);

2.3.3.3. If there are traces of unfair practices being used (bets made in fraudulent manner, obviously "bad" odds" (e.g. obviously incorrect odds), switched odds);

2.3.3.4. There is a deviation from the current Rules during the acceptance of a bet;

2.3.3.5.There are other circumstances confirming the incorrect bet;

2.3.3.6. The bet was made after an event had started or the occurrence had already taken place;

2.3.3.7. The outcome of the event or market at the time of placing the bet was already known or if the odds have not been updated correctly due to technical issues

2.3.4. If there is an obvious error in the odds or limit of the market, bets (placed on odds with an obvious error or exceeding the limit of the market) on that market may be void. If for any reason a bet is accepted after an event has started bets will have action unless a material advantage has been gained by the end user. Kizzy reserves the right to void the bet if it was determined that an unfair advantage has been gained.

2.3.5. In case of suspicion of an unfair activity, Kizzy reserves the right to void any bet (in these cases, the payout is made with odds of "1") or suspend any withdrawals for up to 31 calendar days.

2.3.6. For end user accounts with minus (negative) balances, Kizzy reserves the right to void any pending Bets, whether placed with funds resulting from the error or not.

2.3.7. Kizzy reserves the right to suspend the acceptance of bets of any unique end user without prior notice.

2.3.8. Kizzy shall not be responsible for the damage incurred by the end user as a result of a system malfunction, defects, delays, manipulations or errors in data transfer.

2.3.9. Abuse of gaming software errors or mistakes in translation is prohibited. An end user / operator who discovers any error in the gaming software must immediately report it. If an end user/operator abuses errors in the gaming software, Kizzy reserves the right to suspend End User's betting account, freeze the funds and cancel placed and/or already resulted bets.

2.4. Betting Integrity

2.4.1. Kizzy may limit the maximum amount of a bet or a stake at its discretion to any event, market, operator or end user individually. Maximum bet/stake limits are subject to change without prior written notice. Changes do not apply to bets that have already been accepted.

2.4.2. End Users are allowed to bet only as individuals. Group bets are not allowed. Repeated bets on the same outcome made by the same or different end user may subsequently be declared void at Kizzy's sole discretion.

2.4.3. Even after the official result of the event is already known, Kizzy may consider the indicated bets invalid if it considers that the end user(s) act in collusion or as a syndicate, or the bets considered were made by one or more end user(s) within a short period of time.

2.4.4. Kizzy has the right to refuse to accept bets or to count already made bets as void if they are made from different game accounts from the same IP address.

2.4.5. Kizzy may make an event or market unavailable for betting in case there is a suspected integrity, fairness, game or system fault, until the issue is resolved, Kizzy may depending on circumstances - suspend the betting on any event or market; withhold the settlement and decline any bet until the fault has been resolved, at all times taking decisions fairly, reasonably and in good faith;

2.4.6. Placing bets on manipulated events and/or markets is strictly prohibited on our platform. Any attempt to wager on events or markets that have been predetermined or manipulated in any way undermines the integrity of the Kizzy betting ecosystem and is a violation of our Betting Rules. End users found to be involved in betting on manipulated events and/or markets will face immediate restrictions and cancellation of the Bets. We are committed to upholding the integrity of social media betting and have zero tolerance for activities that compromise fair play and the trust of our end users. By using our platform, end users agree to refrain from participating in any form of betting related to manipulated events and/or markets and understand that violation may result in permanent restriction from betting in the Kizzy platform. Any disputes regarding suspected involvement in betting on manipulated events and/or markets will be thoroughly investigated by our team, and decisions will be made in accordance with our policies. We encourage end users to report any suspicious activity related to manipulated events and/or markets to our support team for investigation.

2.4.7. In any case where there is a game or system fault, including where event betting transactions are not recoverable, the bets placed shall be void and the stakes returned to the end users.

2.4.8. In case of impossibility to get time related official data of the event, Kizzy shall void the bets affected by the delay.

2.4.9. The use of arbitrage strategy, which involves exploiting differences in odds across different bookmakers/sportsbooks to guarantee profit, is strictly prohibited on the Kizzy platform. We do not condone any form of betting activity that aims to manipulate odds or exploit discrepancies for guaranteed profit. End users found engaging in arbitrage betting will face immediate cancellation of their bets. Our platform is designed to offer fair and competitive betting opportunities to all end users, and any attempt to circumvent this principle undermines the integrity of our platform. By using our services, end users agree to refrain from employing arbitrage strategies and understand that violation may result in permanent restriction. Any disputes regarding suspected arbitrage activity will be resolved at the discretion of Kizzy, and decisions will be final.

2.5. Miscellaneous

2.5.1. All references to time periods (time as in ‘clock’, not time as in ‘duration’) in the Rules relate to the time zone in which the event takes place, which varies depending on the market. Customers should pay close attention to the local times presented to them during betting. For example, a reference to the start time of a followers betting event may be marked on the App as occurring at 08:00 for a specific user, but 13:00 for another user in a different time zone.

2.5.2. All information supplied by the App is done so in good faith. However, Kizzy cannot accept liability for any errors or omissions in respect of any information, such as the posting of prices, runners, times, scores, results or general statistics.

2.5.3. Kizzy reserves the right to correct any obvious errors and shall take all reasonable steps to ensure markets are created, administered, suspended and settled with transparency.

2.5.4. Kizzy reserves the right to withhold any payouts pending the completion of integrity checks on an event. Payouts may be delayed or denied if there is any suspicion or evidence of manipulation, fraud, or violation of market Rules or App policies.

2.5.5. If an incorrect creator or competitor name is displayed (excluding minor spelling mistakes) or the incorrect number of creators, competitors or outcomes is displayed in any complete market or a market is otherwise loaded using incorrect information (for example listing an ‘YouTube’ creator as the Twitter’ creator) or includes any other obvious error, then Kizzy reserves the right to suspend the market and (providing it acts reasonably) to void all bets matched on the market. Kizzy will be the sole arbiter of what is defined as ‘acting reasonably’, but any and all good faith effort(s) shall be made.

2.5.6. Customers are responsible for ensuring that they satisfy themselves that the selection on which they place a bet is their intended selection. For example, in the case of a Creator Account bearing the same name as another individual not competing in the relevant event, the onus is on the customer to ensure that they know which Creator Account Kizzy has loaded into the relevant market and to ensure that they are placing their bet on their chosen Creator Account event market .

2.5.7. Kizzy reserves the right at any time in its sole and absolute discretion to suspend a market.

2.5.8. Kizzy may, in its sole and absolute discretion, decide to suspend betting on a market at any time (even if such suspension is earlier than anticipated according to the event situation). In the interests of maintaining integrity and fairness in the markets, Kizzy may also void certain bets in a market or void a whole market in its entirety.

2.5.9. Kizzy reserves the right to amend the Rules at any time. Any such revision will be binding and effective immediately on the posting of such rule changes on kizzy.io and any markets loaded after the new Rules have been posted shall be governed by the new Rules.

2.5.10. The Terms are drafted in English. Any translation into another language is only for the convenience of the reader. In the event of any conflict or inconsistency the English language shall prevail over any translated version.

2.5.11. If the outcome of a market was already known or decided before the placing of a bet, Kizzy may, in its sole and absolute discretion, void any and all bets, withhold or deduct winnings and/or refund wager amounts.

2.5.12. If Kizzy reasonably suspects that a user is, or is acting in coordination with, a creator featured on the App’s markets, Kizzy reserves the right, in its sole and absolute discretion, to take appropriate action. This may include, but is not limited to: restricting access to specific markets, canceling or adjusting affected bets, withholding winnings, or permanently suspending or closing the user’s account. Such measures are necessary to preserve the integrity of Kizzy’s betting ecosystem and to prevent potential conflicts of interest or manipulation.

2.5.13. A “Maximum Win Limit” of up to and equal to USD $10,000 (or its equivalent in different currencies at the time the bet was placed) will apply to any and all bets placed on Kizzy. The Maximum Win Limit is the maximum total amount that Kizzy will credit to an individual customer’s Kizzy account as a result of winnings from bets placed on any type of market.

2.5.14. Kizzy is not obligated to remind users on a case by case basis of this Maximum Win Limit, and users understand and accept that Kizzy’s acceptance of a bet that would imply a potential credit to a user’s account of over this Maximum Win Limit may not necessarily indicate a waiving of this rule on Kizzy’s behalf. Kizzy may, in its sole and absolute discretion, refuse to pay out more than the Maximum Win Limit.

2.5.15. If a customer attempts to circumvent any Maximum Win Limits, whether through the use of multiple Kizzy Accounts, fraudulent betting, or through other means, it will constitute a breach of these Rules. In those circumstances, Kizzy may, in its sole and absolute discretion, take such action up to and including: Canceling the relevant bet(s); Adjusting or withholding winnings; and Closing user(‘s) account(s)

2.5.16. Unless Kizzy has specifically agreed otherwise, an individual customer’s maximum daily winnings are equal to USD $25,000 (or its equivalent in the different currencies at the time the bet was placed).

Part 3 - Specific Rules for Social Media Betting

3.1 Overview of Social Media Betting

3.1.1. Social media betting refers to the placement of bets on event outcomes related to the public-facing activity of social media creators. These outcomes are determined by quantitative performance metrics - such as views or followers - derived from publicly available data on third-party Apps including YouTube and X (formerly Twitter).

3.1.2. Metrics, or Scoring Units, used to determine outcomes in social media betting markets may vary by App. Kizzy offers markets tied to two types of scoring units: (i) views on a specific content piece; and (ii) followers of a creator account. Each event shall clearly indicate the applicable scoring unit.

3.1.3. Each social media betting event is anchored to a specific subject object relevant to the selected scoring unit, such as a content piece such as a post or video (for views) or a creator account (for followers). The applicable App, content type, and object shall be disclosed as part of the event description.

3.1.4. The start and end times for social media betting events vary depending on the App, scoring unit, and subject object. For example: A follower-based event may commence at a scheduled time and run for 24 hours. A view-based event may begin once a content piece is published and run for a fixed window (e.g., 12 hours).

3.1.5. Customers are solely responsible for reviewing and understanding all event details before placing a bet. Kizzy does not guarantee the completeness, accuracy, or currency of any App-derived data or event metadata. By participating, customers accept all risks related to App behavior, metric volatility, and event structure.

3.2. Social Media Betting Manipulation

3.2.1. Social media betting events are inherently subject to manipulation, increased metric volatility, creator and user behavior, and third-party platform algorithms. These events differ materially from traditional sports or casino betting markets. By engaging with Social Media betting, customers accept the risks associated with these dynamics.

3.2.2. Customers understand and accept that each third-party App has differentiated exposure to manipulation, including but not limited to: sybil attacks, automated bot activity, coordinated engagement, algorithmic suppression or promotion, delayed metric updates, and shadowbanning. Kizzy does not control any social media Apps manipulation mitigation methodologies.

3.2.3. Kizzy does not modify, adjust, or curate metrics obtained from social media Apps. Metrics may change unexpectedly due to App updates, moderation decisions, or creator actions. Suspicious or non-organic activity does not, in itself, entitle users to a refund or adjustment. Kizzy shall not be deemed negligent or liable for choosing not to intervene in metric fluctuations that are public-facing and derived from external Apps.

3.2.4. The use of bots, sybil tactics, artificial engagement schemes, or any form of deliberate manipulation - whether by subject creators, or customers - is strictly prohibited. Any customer who initiates, participates in, or benefits from such conduct assumes full legal responsibility for any resulting damages, disruptions, or penalties. This includes, without limitation, harm to: (i): Kizzy and its affiliates; (ii): other customers; (iv): affected social media creators; and (v): the social media platform(s) on which the manipulation occurred.

3.2.5. Kizzy makes no representations or warranties regarding how manipulative behavior may affect third-party App outcomes (e.g., content removal, reduced reach, or enforcement penalties). Participation in Kizzy constitutes an acknowledgment that Kizzy disclaims liability for any adverse effects caused to a creator’s account, engagement rates, App visibility, or reputation.

3.2.6. In the event that Kizzy identifies conduct that renders an event unresolvable or materially compromised such that it impacts Kizzy’s future, Kizzy reserves the right to cancel or void the market in full or in part, in accordance with its refund and integrity policies.

3.2.7. You acknowledge that market manipulation, event fixing, and algorithm blindspot exploitation are inherent and unavoidable risks of social media-based betting. Kizzy explicitly disclaims all liability arising from: (i): false, artificially inflated, or misleading engagement data; (ii): creator behavior intended to manipulate betting outcomes; (iii): market outcomes influenced by sybil or coordinated activity; (iv): errors in algorithmic predictions or pricing blindspots.

3.2.8. By placing a bet, you accept full responsibility for any financial loss caused by market manipulation or social media betting risk phenomena. Kizzy assumes no duty to prevent these behaviors, as they may be out of our control, and bears no liability for settlements influenced by such activity.

3.3 Scoring Units and Settlement

3.2.1. Scoring units will reflect the most granular numerical metric visibly provided to the public by the App on which the Event takes place. For example, if YouTube displays a video's view count as "153.1k," as opposed to 153,100,119 the scoring unit used to determine events shall be recorded as 153,100, not any other number, unless the more granular amount is accessible to the public.

3.2.2. Kizzy shall act as the sole and final adjudicator in determining the final scoring unit value used to settle a market. While Kizzy may consider publicly verifiable data, user claims, or evidence presented, Kizzy’s final decision will be binding.

3.3 Refunds and Void Markets

3.3.1. Kizzy may, at its sole and reasonable discretion, void and refund any market in whole or in part, including but not limited to the following scenarios:

3.3.1.1. If the content tied to the event is deleted, materially altered, or hidden from public view during the event period;

3.3.1.2. If the creator is removed by a Kizzy administrator or found to have breached App Rules;

3.3.1.3. If App outages or internal technical failures prevent the conclusion or verification of the event result;

3.3.1.4. If the event was erroneously created with incorrect metadata, such as the wrong App, creator, content type, or metric.

3.3.1.5. Kizzy reserves the right to refund any market, with or without explanation, to preserve market sustainability, fairness and App integrity. Refunds shall be settled at odds of 1.0.

3..1. If an event is resulted using an obviously incorrect metric (e.g., “9 views” displayed instead of “900,000”), Kizzy reserves the right to correct and re-settle or refund the market.

3.3.2. If Kizzy determines that the wrong piece of content was used to settle the market (e.g., wrong tweet or video), the market may be voided or resettled, provided it can be reasonably corrected in good faith.

3.3.3. Mistakes in creator name spelling, profile image, timestamp, or non-material metadata are not grounds for voiding a market.

3.4 Content Types and Market Start

3.4.1. For markets on user-driven scoring units on content, each event is tied to a specific content type, including, but not limited to a short video or tweet. The market start time is defined as the moment the specified content is publicly posted and accessible via URL.

3.4.2. For markets on user-driven scoring units on creator accounts, each event is tied to a fixed duration which is presented to the user in what Kizzy deems is the timezone of their device. If events do not start due a technical error, Kizzy reserves the right to void or refund bets.

3.4.3. If the subject content type is incorrectly specified or the publishing of the content fails to trigger an event launch (e.g., a tweet is posted but the subsequent betting event), Kizzy reserves the right to decide to void or refund bets.

3.4.4. If a different content type is posted (e.g., a reply instead of a single tweet for X.com, or a video instead of a short on YouTube) and materially impacts the scoring unit used for settlement, Kizzy may void or resettle the market.
